Privacy & security policy

Welcome to XtremeBeautyto.com. Please read the Legal Terms and Conditions carefully before using this Site. By accessing, browsing and using this Site, you are signifying your consent to be bound by the Terms and Conditions. The Terms and Conditions and the related documents may be updated from time to time. We strongly recommend that you review these documents regularly, to ensure you are aware of these changes.

1. INTRODUCTION

At XtremeBeauty Center we believe that when you visit the xtremebeautyto.com website (the “Site”), your personal and account information deserve protection. We has prepared this Privacy Policy to let you know what we can, and cannot do, with your personal and account information, and to ensure that you understand our commitment to providing you with a secure and worry-free experience.

At all times, it is your decision as to whether you wish to use the Site and provide us with information about yourself. Unless you give it to us we will not record or use your personal information.

Throughout this policy we refer to “XBC”, which means each of XBC, the owner and operator of the Site, and its affiliates.

2. COLLECTION OF PERSONAL INFORMATION

You may visit the Site without registering and directly providing any personal information. However you will need to register and provide personal information if you wish to access particular portions of the Site and to use specific functions that are available to you. In other instances, such as when sending XBC an email message or providing us with feedback, we may require that you provide personal information such as your e-mail address, work location, and phone number.

At other times, for instance where one of XBC’s partners is providing a product or service to users of the Site or to those users who are registered to particular parts of the Site, personal and/or account information may be shared with or provided directly to that partner. Where personal information is provided directly by a Site user to another organization at another Site, even if that Site is linked to the Site, XBC shall not be responsible for its collection or use, and the visitor is encouraged to determine the other organization’s own privacy policy.

3. USE OF COOKIES

Where your Internet browser software is set to accept them, our Site uses cookies (a “cookie” is a small file stored on your computers that contains a unique personal identification code) to speed navigation, keep track of information, and provide you with custom-tailored content. We also use cookies to remember information you gave us so you don’t have to re-enter it each time you visit the Site. By showing us how and when visitors use the Site, cookies also help us see which areas are popular and which are not. Improvements and updates to the Site are based on data obtained in this way. Most browsers are initially set to accept cookies. If you’d prefer, you can set yours to refuse cookies.

4. USE OF PERSONAL INFORMATION BY XBC

XBC may use the personal and account information provided in the following ways:

To build and maintain your membership account with XBC.

To process service requests and other types of orders.

To personalise the delivery of content and information to you.

XBC may also use personal and account information and data collected to generate aggregate statistics and reports for internal use and for sharing with legitimate statistics gathering organizations. These statistics and reports will not contain any information that would identify individual users of the Site.

1. PROTECTION OF PERSONAL INFORMATION BY XBC

When you visit the Site and provide personal information to engage in transactions, these are processed through a secure server, using one of the most advanced security systems.

2. DISCLOSURE OF PERSONAL INFORMATION

Visitors’ non-aggregated specific personal and account information will not be sold, rented or made available to anyone other than XBC unless you have given us express permission to do so.

XBC reserves the right at any time to disclose any personal and account information: (i) to comply with any applicable law or regulation; (ii) if such disclosure is necessary or appropriate to site operation; or (iii) to protect the rights or property of XBC and its users, partners, providers, licensors or merchants.

3. LIMITATION OF LIABILITY

Under no circumstances, including, but not limited to, negligence, shall XBC, its subsidiaries or affiliated companies or licensors, or their directors, officers, employees or other representatives be liable for any damages that arise out of or in connection with the use of this Site, even if XBC or a XBC authorized representative has been advised of the possibility of such damages. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall XBC’s total liability to you for all damages, losses, and causes of action (whether in contract, tort (including but not limited to negligence) or otherwise) exceed the amount paid by you, if any, for accessing or using this Site.

4. LINKS TO THIRD PARTY SITES

The links on the Site will enable you to leave the Site and connect directly to linked sites. Such linked sites are entirely independent of the Site, and shall not be construed as any reflection on, any affiliation with, approval of or endorsement by XBC of any such site or entity, or its respective information, publications, products or services. XBC shall not be responsible for the contents of any site linked to this site or for any link contained in a linked site. XBC is providing these links to you only as a convenience and the inclusion of any link does not imply endorsement of the linked site by XBC.

5. JURISDICTION AND SEVERABILITY

You agree and acknowledge that your use of this Site shall be deemed to have occurred and taken place solely in the Province of Ontario, Canada. You further agree and acknowledge that these Terms and Conditions, and any disputes in connection with your use of this Site or its contents, will be governed by the laws of the Province of Ontario, Canada, and the laws of Canada applicable therein. You expressly consent to the exclusive forum, jurisdiction, and venue of the courts of Ontario in any and all actions, disputes, or controversies relating hereto. If any provision of these Terms and Conditions shall be found to be unlawful, void and unenforceable, then such provision shall be deemed severable herefrom and will not affect the validity and enforceability of any remaining provisions.

6. AMENDMENTS

XBC reserves the right to make changes to the Site and to modify, alter or otherwise update these Terms and Conditions at any time with or without notice. You should review this link on a regular basis for any such changes. Your continued use of the Site shall constitute your acceptance of any revisions to the Terms and Conditions.

7. LANGUAGE

The parties have requested that these Terms and Conditions and all documents contemplated hereby be drawn up in English or Spanish.

8. INDEMNIFICATION

To the maximum extent permitted by applicable law, you will defend, indemnify and hold XBC, its affiliates and related companies, and any of their respective directors, officers, employees, consultants and agents, harmless from and against all claims, liability, and expenses, including all legal fees and costs, arising out of (i) your breach of any provision of these Terms and Conditions, or (ii) your use of the Site and the contents contained on the Site.

XBC reserves the right, in its sole discretion and at its own expense, to assume the exclusive defence and control of any action, claim or matter otherwise subject to indemnification by you. You will co-operate as fully as reasonably required in the defence of any claim.

9. USER PRIVACY AND SECURITY POLICY

You recognize and agree that: (i) the Internet is not a secure medium, and neither the privacy of your communications, nor visits to this Site, can be guaranteed; (ii) the nature of Internet communications means that your communications may be susceptible to data corruption, unauthorized access, interception and delays; (iii) the Site may include incomplete information, inaccuracies or typographical errors; (iv) XBC and any other persons involved in the management of the Site may make changes in the information and content included in the Site at any time without notice; (v) XBC shall not be responsible for any detrimental reliance you may place on the Site or its contents; and (vi) use of the Site is on an “as is” basis and is strictly at your own risk.

Use of this Site is also subject to the terms of our Security Statement. You recognize and agree that although XBC security efforts are generally consistent with industry practice in Canada, your complete privacy, confidentiality and security associated with any communications between us is not yet possible over the Internet, and therefore cannot be guaranteed. As a result, XBC shall not be responsible or liable for any loss of privacy, disclosure of information, harm, damage or loss that may result from your transmission of any information to us in any connection with the Site.
